42/46 Boundary Strip Make Good Plan

SC Meeting - 46 VP Boundary Make Good
Date/Time of Meeting: 06FEB20 / 17:30-18:30

Units represented: 4, 5, 11, 14, 16 & 18
The construction at 46 Victoria Parade appears to be nearing completion. Graham Butson (u5) had raised an issue regarding our boundary with 46 Victoria Parade which is now a narrow strip (~800mm). Apparently, the strip is jointly owned with the majority of the width owned by our Strata. Graham said that the neighboring construction has resulted in:
● the removal of our boundary line plants (> 2m high);
● damage to our car park louvres;
● the decommissioning of our watering system;
● construction fluids permeating the soil along the strip;
● the accumulation of building rubble and other stuff along the strip; and
● damage to our entry corridor lattice.
Apparently, our Strata does not have any written agreement or MOU with a relevant party to ensure that our boundary is made good at the end of construction. As such and with Graham's encouragement, the SC led a discussion with attending unit owners to establish our Strata's position on the make good elements for the boundary strip.
The SC raised an issue from a fire safety audit related to our garage louvres and proximity to the boundary. The garage louvres are too close to the neighbouring building under current BCA requirements, but a performance solution would be available recognising the 46VP boundary wall would serve as a radiant heat barrier. It would require that no combustible materials are in the area from the entry stairs to the AusGrid building. Also, no obstructions in that area would be appropriate as it would restrict garage ventilation. With these considerations, the SC encourage the owners to seek cooperative relations with the 46VP owners.
The SC committed to trying to establish a working relationship with 46VP owner(s), and with the developer. And to submitted a list of make good items for the builder to fix.

The SC submitted a 46VP Construction Effects to the 46VP Developer on 24MAR20. The Developer responded on 03APR20 with a commitment to related undertakings. The builder late began improvements. Both the Developer and the Builder requested at different times for the SC to request 42VP owners not to interfere with the builder. The builder had been diligently fixing construction effects, but became increasingly frustrated with interferance. Communication with the Developer and Builder faded in early May 2020. The SC intends to follow up with the Developer/Owner(s) at a later date.
